Hey Guys - long time no post. I recently got asked by dozens and dozens of viewers and friends to weigh in on that crazy Ferrari Arkansas case. You know, the one with the $5.8 million dollars punitive damages award for a used car.

It turns out that the whole thing may have been preventable by the dealer. They apparently didn’t use the same Purchase Agreement which has become standard pretty much everywhere in the entire free world. And it cost them dearly (ie., a pile of cash). It’ll probably get turned around on appeal but I explain it in this morning’s video.

Really interesting. Was it at all mentioned what it would cost to replace or repair the header? Do you figure that it will get knocked down to enough to fix the car, cover his fees and pad his pockets just a bit?

I kinda did a laugh/cry when you talked about your rule of going and seeing the car personally and having your own guy/shop check it out. That’s normally a rule of mine too, but I just finished the agonizing process of importing a 25 year car from Amsterdam which began with me wiring a a bunch of money to a total stranger in Europe . Everything is fine now, the car has arrived and I’m overjoyed but I lost some sleep and some hair over it.

A 1975 BMW 1502. The entire saga is detailed in my past posts if you’re interested. In short it was a giant anxiety ridden leap of faith, but the only real problems I ran into were with the US customs broker...Terrible communication, I did most of the work I paid them to do, then I had to grease the delivery driver they hired with $300 ( in addition to the $375 I paid them for delivery) for him to finish the job.

Anyway, it’s all good now!

Funny - I bought a car from the same dealer (actually worked with the Mazda dealer next door - same owner, car was traded in at the Mercedes dealer) . They listed a used MDX for a great price and I called about it (and thankfully, took a screenshot at that time ). The dealer i s a couple hours from my place, but I was heading that way anyway and took a test drive and liked the car (for my wife). When I got back home and checked the ad again, the price has been adjusted up several thousand dollars (closer to avg dealer price for what it was). I spoke to them about it - they said they’d initially listed it too low but were willing to honor the price, and after we worked out all the details, they actually delivered the car to me at no charge! We’ve put nearly 100k more miles on it since - great car.

Unfortunately, people are easy to fool, but instead of saying it’s that people are dumb, it’s because people naturally trust the evidence that they are presented with because we need to be secure in our reality, and trust the information that our brains present us.  which is why true psychopaths find it so easy to con people. without pattern recognition (buying dozens of cars) people really have little chance unless they go in with that kind of mindset.
